Disclaimer of liability
Registration with China-Gadgets.com does not create a contractual relationship between the user and the partner companies. TriMeXa Ltd does not act as a representative of the partner companies, but merely presents offers of the respective partner companies via www.china-gadgets.com. Contracts within the scope of purchases from partner companies are concluded exclusively between the user and the partner company. The user agrees to independently verify the information and conditions described on the respective offer page of the partner company and to decide on his own responsibility, whether he agrees to the contractual conditions stated there.
TriMeXa Ltd does not assume liability for breaches of duty arising from contracts that exist within the scope of purchases and orders between the user and partner companies. Furthermore, all other matters directly related to the orders are exclusive agreements between the user and the partner company.
Furthermore, TriMeXa Ltd does not assume liability for the correctness and completeness of the information taken from its partner companies. The respective partner company is entirely responsible for the availability, proper dispatch and faultlessness of the partner company’s products as well as for its billing.
Content liability
The contents of our pages have been created with the utmost care. However, we cannot assume any liability for the correctness, completeness, and topicality of the contents. This applies in particular to gadget deals, user gadget deals and all links leading to external offers.
Liability for links
Our website contains links to external websites of third parties over whose contents we have no influence. Therefore, we cannot assume any liability for these external contents. The respective provider or operator of the pages is always responsible for the contents of the linked pages. The linked pages were checked for possible legal infringements at the time of linking. Illegal contents were not recognizable at the time of linking. However, permanent monitoring of the content of the linked pages is unreasonable without concrete evidence of a violation of the law. If we become aware of any infringements, we will remove such links immediately. Furthermore, TriMeXa Ltd cannot be made liable for changed conditions on the respective linked provider sites, be it changed prices or other conditions, which are described in an article on China-Gadgets.com and may no longer be applicable. The user within the meaning of § 2 S.1 No.3 TMG, who follows a link from China-Gadgets.com, is responsible for carefully checking the conditions of the provider and only executing a contract or an order if the conditions found at the provider are accepted accordingly.
Comments
Through China-Gadgets.com, TriMeXa Ltd enables users to publish comments on the individual offers. None of the contents in comments represent an opinion of TriMeXa Ltd, but are autonomous contributions of the respective users. TriMeXa Ltd therefore rejects any responsibility for these contents and hereby expressly distances itself from said contents. There will be no moderation / preliminary check of the contributions. Untrue factual claims, i.e. statements which are not covered by the protection of the freedom of expression of Article 5, Basic Law for the Federal Republic of Germany as well as threatening, abusive, racist, violence-glorifying, defamatory, harassing, offensive, insulting, pornographic, harmful to minors or any other illegal content, especially abuse criticism, will be removed or not published by TriMeXa Ltd upon discovery. The user has no claim to publication of his comments, TriMeXa Ltd can refuse publication or remove an already published comment at any time without stating reasons. In addition, the user releases TriMeXa Ltd and its employees and shareholders from all claims asserted by third parties against TriMeXa Ltd that the content posted by the user infringes the rights of third parties or violates legal regulations; this includes the reasonable costs of legal defence.
Copyright
The contents and works created by the site operators on these pages are subject to German copyright law. Duplication, editing, distribution and any kind of use outside the limits of copyright law require the written consent of the respective author or creator. Downloads and copies of this site are only permitted for private, non-commercial use. As far as the contents on this site were not created by the operator, the copyrights of third parties are respected. In particular, the contents of third parties will be marked as such. Should you nevertheless become aware of a copyright infringement, please inform us accordingly. As soon as we become aware of any such infringements, we will remove the respective content immediately.
With the creation of a contribution (e.g. comment, user gadget and similar) the user grants the operator (TriMeXa GmbH) an exclusive, temporally and spatially unlimited and free of charge right to use the contribution for all known and still unknown, be it current and future, types of use and purposes. The right of use shall remain in force even after termination of membership.
Duties of the user and responsibility for posted contents
By registering with China-Gadgets, the user agrees that the contributions posted by him do not violate the aforementioned terms of use or applicable law, and, in particular, that no rights of third parties are infringed by their contributions. Illegal contents are in particular contents protected by copyright if no authorization for use exists, untrue factual allegations, racist, xenophobic, discriminating or offensive contents as well as pornographic, adult and violent contents. The glorification of drugs and other illegal addictive substances will also not be tolerated.
Minimum age
The minimum age to use our offer is 16 years. Otherwise, the consent of a parent or guardian is required.
Measures and sanctions
In case of a violation of our terms of use and/or applicable law, TriMeXa Ltd reserves the right to delete inadmissible contributions, to issue a warning and/or to block the user temporarily or permanently if necessary. The same applies if, in the opinion of TriMeXa Ltd, one or more users disturb the climate and/or cooperation of the community.
Indemnification with respect to third-party claims
Should TriMeXa Ltd be claimed by third parties due to an illegal contribution, it reserves the right to retrieve the costs incurred from the author of that illegal contribution. In addition to violations of criminal law, this also includes violations of copyright (violations of moral rights within the meaning of §§ 12 et seq., Act on Copyright and Related Rights; Violations of exploitation rights within the meaning of Sections 15 ff. UrhG; infringements of the protection of photographs pursuant to Section 72 of the Act on Copyright and Related Rights) and violations of personal rights.
Terms of use for sweepstakes
Sweepstakes on our platforms (blog, Facebook, Twitter) are organized and handled by TriMeXa Ltd. The offer is limited in time and is subject to the conditions stated here. Anyone who does not agree to these conditions may not take part in the competition.
Any promotions conducted through liking and commenting posts are not part of the Facebook network and are not offered, maintained or supported by Facebook. The organizer of these competitions is TriMeXa Ltd. All data provided by the participant (by personal message or e-mail) will not be transmitted to Facebook in any way. The participant data will be used exclusively for notification of prizes and relevant information (e.g. dispatch) relating to the current competition.
Eligibility
All persons who are at least 16 years old and have their permanent residence in the Federal Republic of Germany, Switzerland or Austria are eligible to participate. In addition, users must be a fan of the Facebook page on which the competition was published. Employees of TriMeXa Ltd and their relatives are excluded from participation in the sweepstake.
Registration for participation
Users wishing to participate in the sweepstake(s) must be accessible through their Facebook profile, so that our employees are able to inform the user of their win. In addition, participants agree that, should they win, their Facebook name will be published on the corresponding Facebook page.
Exclusion of participants
Incorrect information (Facebook name and e-mail address) can lead to the exclusion of the participant from the draw. Multiple entries with different email addresses / Facebook names will also result in elimination from the prize draw and the distribution of prizes. Any attempt at manipulation will result in immediate expulsion. A comment with an advertising link (e.g. affiliate) does not count as participation and will be deleted unless the competition requires this for participation.
End of the raffle and prize notification
Once a winner has been determined and the name has been published on the Facebook page, the draw ends. TriMeXa Ltd reserves the right to end the draw at any time and without stating reasons. The winner(s) will be marked under the competition post or in a new entry and/or informed by personal message and/or displayed with name/profile picture in photo form. The participant is aware that messages via Facebook can end up in the Miscellaneous folder and are therefore not immediately displayed. Participants are recommended to view the competition post approximately 24 hours after the closing date for entries in order to find out independently about the name of the listed winner(s). Users who fail to respond to a winning notification within one week will lose their claim to the prize.
Caveat emptor
TriMeXa Ltd assumes no liability for direct or indirect damages that may result from participation in the raffle. We are not liable for competition entries (e.g. comments, links or pictures) that are illegal. The contributions must not contain any insults, untrue statements of fact, infringements of competition law, trademarks or copyrights. Users will be made responsible for any legal infringements. In particular, we are not liable for draws meeting the expectations and ideas of the participants; that the mail server is accessible at all times; that all data is always transmitted on time and error-free; that the software we use functions permanently and perfectly; that data is deleted or lost due to technical or human error.
By participating (liking, commenting on the competition entry, uploading pictures) the user agrees to the above conditions of participation and the data protection guidelines.
Changes to these terms and conditions
TriMeXa Ltd is entitled to change the general terms and conditions and other conditions of use. The provider will only make these changes for valid reasons, in particular due to new technical developments, changes in case law or other equivalent reasons. If the contractual balance between the parties is significantly disturbed by the amendment, the amendment shall be omitted. For the rest, changes require the customer’s consent.
Severability Clause
Should individual provisions of this contract be invalid, this shall not affect the validity of the remaining provisions. The contracting parties will endeavour to find an effective provision instead of the invalid provision which comes as close as possible to the economic meaning of the invalid provision.
